TERMS AND CONDITIONS (PAPADEN / PAPADEN LTD)

These Terms and Conditions apply to purchases made through the Papaden online store (the "Store"). Governing law: England and Wales.

2. Definitions

Consumer — an individual buying wholly or mainly for personal use.

Goods — physical printed posters and framed prints.

Digital Content — files supplied in digital form, for example PDF or PNG poster files.

Personalised — made to your specification or clearly customised, for example with a name, date, photo, facts panel or zodiac panel.

3. Product nature

Our products are personalised newspaper-style posters. They are decorative artwork and not an actual newspaper publication. Facts and year highlights are curated from historical sources and may vary between sources. Product images are illustrative; colours may vary between screens and print output.

4. Contract formation

4.1 Your order is an offer to purchase. A contract is formed when we accept your order, usually by sending an order confirmation and, for Personalised items, once we begin personalisation work.

4.2 You must ensure all order details are complete and accurate, including spellings, dates, email address and delivery address where relevant.

4.3 For some products we may need personalisation details and/or a photo after checkout. We will contact you using the details you provided. Production timelines begin once all required details are received.

5. Proofs

5.1 A free proof (preview) is provided for every personalised item. We send it within 24 hours of receiving your personalisation details. You do not need to request it.

5.2 Nothing is printed or supplied until you approve your proof. Changes at the proof stage are free.

5.3 If you approve a proof, you confirm that the personalisation details are correct as shown in that proof. The approved proof is the reference point for accuracy.

6. Prices, payment and promotions

6.1 Prices are shown on the Store and at checkout. Any delivery charges for Goods are shown before you place your order.

6.2 Payment is taken at checkout using the payment methods made available in the Store.

6.3 If pricing or listing information is obviously incorrect due to an error, we may cancel the order and refund you in full.

7. Digital Content supply and technical requirements

7.1 We typically supply Digital Content within 1 business day (approximately 24 hours) after receiving all required personalisation details and your proof approval.

7.2 Digital Content is delivered by electronic means, for example an email download link and/or access in your customer account.

7.3 You are responsible for providing a correct email address, checking spam and junk folders, and ensuring you can open the file format supplied and have suitable software and printer settings if you print locally.

8. Delivery of Goods

8.1 Dispatch times are stated on the relevant product page or at checkout. For Personalised Goods, dispatch times start once we receive all required details and your proof approval.

8.2 Delivery is complete when the Goods come into the physical possession of you or a person you nominate. Risk remains with us until then, subject to limited statutory exceptions.

8.3 Unless we agree otherwise, Goods will be delivered without undue delay and within 30 days.

8.4 Delivery estimates are not guarantees. If delivery is materially late, contact us and we will work with you on the available remedies.

9. Cancellation rights

9.1 Non-personalised Goods: if you are a Consumer buying non-personalised Goods at a distance, you generally have a legal right to cancel within 14 days after delivery, subject to the conditions in our Cancellations, Returns and Refunds Policy.

9.2 Personalised Goods: the legal right to cancel for change of mind does not apply to Goods made to your specification or clearly personalised.

9.3 Digital Content: where supply begins during the cancellation period, you lose the right to cancel only if you gave express consent at checkout and acknowledged that the right would be lost once supply begins.

9.4 Nothing in this section affects your rights where an item is faulty, damaged or not as described. See our Cancellations, Returns and Refunds Policy for those rights in full.

10. Customer content and acceptable use

10.1 If you upload or supply photos, names, text or other content, you confirm that you have the right to use and provide it and that it does not infringe third-party rights.

10.2 We do not accept content that is unlawful, or that infringes rights, including hate content, harassment, or content that infringes intellectual property.

10.3 You grant us a limited licence to use customer-supplied content solely to create and supply your order and to handle customer service queries relating to it.

11. Intellectual property

All Papaden designs, templates, layouts and artwork are protected by intellectual property laws. Purchase grants a personal-use licence only. You must not resell, redistribute or commercially exploit digital files. See our Intellectual Property Policy for the full terms and for how to report an infringement.

12. Liability

We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud. Subject to your statutory rights, we are not responsible for issues caused by incorrect personalisation details you provided, colour differences between screens and printers, or carrier delays outside our control.

13. Governing law

These Terms are governed by the laws of England and Wales. If you are a Consumer, you may bring proceedings in the courts of the part of the UK in which you live.
