Terms and Conditions

These Terms and Conditions apply to purchases made through the PapaDen online store (the “Store”).

1. About us

These Terms and Conditions (Terms) apply to purchases made through the PapaDen online store (the Store).

2. Definitions

  • Consumer means an individual buying wholly or mainly for personal use.

  • Goods means physical printed posters and framed prints.

  • Digital Content means digital files supplied in digital form (for example PDF/PNG poster files).

  • Personalised means made to your specification or clearly customised (for example name, date, photo, facts panels, astrology/zodiac panels).

3. Contract formation

3.1 Your order is an offer to purchase. A contract is formed when we accept your order (usually by sending an order confirmation) and, for Personalised items, once we begin personalisation work.

3.2 You must ensure all order details are complete and accurate (including spellings, dates, email address and delivery address, where relevant).

3.3 For some products we may require personalisation details and/or a photo after checkout. We will contact you using the details provided. Production timelines begin once all required details are received.

4. Product information and proofs

4.1 Product images are illustrative. Colours may vary between screens and print output.

4.2 Where offered, a proof (preview) is provided on request unless stated otherwise. If you request a proof, you must check it carefully. If you approve a proof, you confirm the Personalised details are correct as shown in that proof.

4.3 Facts and year highlights are curated from historical sources and may vary between sources. The design is decorative artwork and not an actual newspaper publication.

5. Prices, payment and promotions

5.1 Prices are shown on the Store at checkout. Any delivery charges (for Goods) are shown before you place your order.

5.2 Payment is taken at checkout using the payment methods made available in the Store.

5.3 If pricing or listing information is obviously incorrect due to error, we may cancel the order and refund you.

6. Digital Content supply and technical requirements

6.1 We typically supply Digital Content within 1 business day (approximately 24 hours) after receiving all required personalisation details and (if requested) proof approval.

6.2 Digital Content is delivered by electronic means (for example email download link and/or access in your customer account).

6.3 You are responsible for:

  • Providing a correct email address, and checking spam/junk folders.
  • Ensuring you can open the file format supplied and have suitable software/printer settings if you print locally.

7. Delivery of Goods (physical prints and frames)

7.1 Dispatch times are stated on the relevant product page or at checkout. For Personalised Goods, dispatch times start once we receive all required details and (if requested) proof approval.

7.2 Delivery is completed when the Goods come into the physical possession of you or a person you nominate. Risk remains with us until then (subject to limited statutory exceptions).

7.3 Unless we agree otherwise, Goods must be delivered without undue delay and within 30 days.

7.4 Delivery estimates are not guarantees. If delivery is materially late, please contact us and we will work with you on the available remedies.

8. Consumer cancellation rights and personalised items

8.1 Non-personalised Goods: if you are a Consumer buying non-personalised Goods at a distance, you generally have a legal right to cancel within 14 days after delivery (subject to conditions set out in our Refunds and Cancellation Policy).

8.2 Personalised Goods: the legal right to cancel for change of mind does not apply to Goods made to your specifications or clearly personalised.

8.3 Digital Content: if Digital Content is supplied during the cancellation period, you lose the right to cancel only if you gave express consent and acknowledged that your right to cancel would be lost once supply begins.

8.4 Nothing in these Terms affects your statutory rights if Goods or Digital Content are faulty or not as described.

9. Faulty, incorrect, or misdescribed items

9.1 If what you receive is faulty or not as described, you have statutory rights under the Consumer Rights Act 2015. This includes remedies relating to Goods and Digital Content.

9.2 For Personalised items, if the fault arises because the information you provided was incorrect (for example a misspelt name or wrong date), this is not a fault with the product. See our Refunds and Cancellation Policy for how we handle customer-input errors.

10. Acceptable use and customer content (photos/text supplied by you)

10.1 If you upload or supply images, names, text or other materials (Customer Content), you confirm you have the right to provide them and they do not infringe third-party rights.

10.2 You grant us a limited licence to use Customer Content solely to create, personalise and supply your order, and to deal with customer service queries about that order.

11. Intellectual property

All designs, templates, layouts and artwork provided by PapaDen are protected by intellectual property laws. See our Intellectual Property Policy for full terms of permitted use.

12. Limitation of liability

12.1 We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

12.2 Subject to 12.1, we are responsible for foreseeable loss or damage caused by our breach of these Terms or negligence. We are not responsible for losses that are not foreseeable.

12.3 Subject to your statutory rights, we are not responsible for:

  • Issues caused by your incorrect personalisation details.
  • Colour differences due to screens/printers.
  • Delays caused by events outside our reasonable control (for example carrier network disruption), although this does not remove your legal remedies for non-delivery or excessive delay.

13. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you place your order applies to that order.

14. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction (subject to any mandatory consumer protections applicable to you).
